NEW DELHI: The Supreme Court of India commuted the death sentence for Santosh Singh, the accused in the Priyadarshani Matto murder case, to life sentence.

Priyadarshini's father was shattered and dismayed on hearing this judgment pronounced by the highest court of our country. He had laid down expectations for better treatment from the court.

The 23-year-old law student, Priyadarshini Mattoo was supposedly raped and strangled in her home at Vasant Kunj in the capital in January 1996. Santosh Singh was a senior student of the same college.

The Delhi High Court had declared Santosh Singh guilty of rape and murder of Matto in October 2006 and had sentenced him to death. Singh, who was a lawyer till he was sent to jail, appealed against the death sentence in the Supreme Court. "For a murder so grotesque and brutal, the convict deserves nothing less than the death penalty," the High Court had declared. The law experts said its decision was based on a amalgamation of forensic as well as circumstantial evidence.

This decision reversed the earlier verdict by a lower court in Delhi that had acquitted Singh on basis of benefit of doubt. A judge, at that time, had even insisted that it was due to the lag on part of the Delhi Police that he was forced to acquit Singh even though he knew that Singh "is the man who committed the crime".

The Supreme Court said today that, "To our mind, certain things are in favor of appellant (Singh). We are converting the punishment of death sentence into the life imprisonment."

Priyadarshini had complained a year before her murder, in 1995, that Santosh Singh was stalking her. Singh was even seen, on 23 January 1996, entering into the Vasant Kunj residence of Priyadarshini. She was discovered dead by her domestic maid. She had been first raped and then strangled using an electric wire with her face totally smashed with a motorcycle helmet. Singh's shattered helmet was later recovered that acted as a substantial evidence against him.

Critical DNA tests conducted on Singh were rejected by the trial court that directly linked him to the deliberate rape and murder of Priyadarshini but were later accepted by the High Court of Delhi. Both courts had concurred on the fact that the delay in the case was because Singh's father was a senior police officer.

The High Court condemned the police sassing that the rule of law, "The High Court slammed the police, stating that the rule of law “is not meant for those who enforce the law nor for their near relatives”.
